INTRODUCTION

Welcome to ShopKiasha!

These section set out the terms and conditions on which products are supplied to you as a buyer on www.shopkiasha.com, our mobile application, mobile website or social media and messaging (together defined as the “Site”) for its own benefit and the benefit of its affiliates and subsidiaries (together “we”“our” or “us”) in the United Arab Emirates (“UAE”). The owner and operator of the Site is Kiasah Personal Care Trading LLC, a limited liability company registered in the UAE.

Please read these terms carefully before you submit your order via the Site. By placing an order on the Site, you are agreeing to be bound by these Terms & Conditions with immediate effect.

The Site is provided to you for your personal use subject to these terms and conditions and any other rules posted on the Site (including our Privacy Policy) (the “Terms and Conditions”).

By visiting the Site, you agree to be bound by, consent to comply with, and consent to the practices described in, these Terms and Conditions, which govern your access and use of the Site and all content and functionalities available on the Site (or any of our other Sites and related micro-sites accessed through the URL www.shopkiasha.com and related domain names) (the “Services”).

We may change these Site Terms from time to time without notice to you by posting the updated Site Terms on the SIte, so please be sure to check regularly for updates. When you place an Order through our Site or the Site Call Centre, you are deemed to have consented to the latest version of the Site Terms then posted on our Site. If a change in law means that we have to change our Site Terms after you have placed an Order but before it has been fulfilled, we are obliged to apply that change to your Order.

ELIGIBILITY

We aim to make the Site and its associated services available to as many of you as possible. However, we do require that you are above the legal age for purchasing products in your country of residence, able to lawfully:
(i) make payment through one of our accepted tender types;
(ii) agree to these Terms; and
(iii) enter into binding Orders with us.
In addition, only Orders with complete delivery addresses can currently be processed via the Site. Please refer to the Delivery section below. The Site is for your personal or gift use only and commercial usage is not permitted. We reserve the right to decline Orders where we suspect commercial usage.

PLACING ORDER & ACCEPTANCE

Pricing

Whilst we endeavor to ensure the prices on the Site are as accurate as possible, we reserve the right to change a price in exceptional circumstances. If a price is corrected due to exceptional circumstances, customers will be informed of the change before payment is processed and offered the opportunity to amend/cancel the order. All prices are listed exclusive of VAT, where appropriate. All prices are subject to change without prior notice.

Order Acceptance:

Our acceptance of your order will take place when we notify you of our acceptance in writing (e.g. by email or mobile messaging). If we are unable to accept your order, we will inform you of this in writing or through a call and will not charge you for the product.

By placing an order, you authorise us or our third-party payment processer to process your credit/debit card details for the amount of your order. We accept payment by,credit/debit card;
via your wallet; or
cash on delivery (an amount not exceeding AED 1,500.

In order to authorise credit/debit card payments, we may be required to create an account for you with our third-party payment processors, including accepting their standard terms and conditions and submitting your details to them on your behalf. You hereby authorise us to do so and we shall not be liable to you for any damage or loss you may incur as a result.

We may remove or add cards or other payment methods that we accept at any time without prior notice to you.

Cancelling Order:

You may cancel your order immediately prior to shipping for any reason.

Our Cancellation:

We may cancel your order(s) if:

(i) you do not make any payment to us when it is due;
(ii) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products;
(iii) or you do not, within a reasonable time, allow us to deliver the products to you or collect them from us; or
(iv) you attempt to bulk or multi-order purchase in accordance with below.

Bulk/Multiple Purchasing:

We reserve the right to reject any orders, at our sole discretion, where we detect bulk purchasing or multiple units of similar products being purchased.

Guarantees:

On request, we will provide information about any manufacturer’s guarantee or any guarantee offered by us in respect of the Products, but we are not legally responsible for any obligation under manufacturer’s guarantees. The guarantee does not affect your statutory rights.

 

ORDER DELIVERY/ SHIPPING

The shipping options available to you are determined by the contents of your order and your shipping address. The Checkout page will only display the shipping methods available for your order.

Orders within UAE are shipped free of cost for orders over AED 200 (Excluding VAT), below this there is an AED 25 shipping and handling charge which cannot be waived off.

Orders will be processed and delivered within 2 - 3 Business days.

Delivery Costs:

The costs of delivery will be as displayed to you on our Site.

Delivery Delays:
If our supply of the product is delayed by an event outside of our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay;
If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will notify you of how to rearrange delivery or collect the product;
If you do not collect the product from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot, we will contact you for further instructions. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection, we will cancel your order.

ID Requirement Upon Delivery: 

We may, at our sole discretion, make any inquiry we deem necessary to verify your identity and/or ownership of your financial instruments by requesting that you provide us with further information or documentation, including, but not limited to requesting a form of identification and/or credit card. If we are unable to verify or authenticate any information you provide, we have the right to refuse delivery and cancel the order.

The following forms of ID are accepted:
Original & Valid National ID
Original & Valid Driving License
Original passport (profile and visa page)

Title to Products: 

A product will be considered owned by you and your responsibility from the time we deliver the product to the delivery address and you have paid for the product.

Invoice:

We will issue an electronic invoice for your purchase and send such invoice to the email address you provided to us.

Returns

In case you have received a product which not as ordered, damaged, defective or not as described on the site, please report the same immediately to our support team (support@shopkiasha.com) on the day of delivery of the goods and the replacement will be on its way to you.

Please note that for us to process a refund the product should be returned unused, in original unbroken packaging and include all tags.

We don’t do returns if you have changed your mind.

Refunds:

Customer can claim for Refund for the purchased Product(s) within 2 days from the date of receiving the Product(s).


Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery.

Shipping and payment processing charges, if any, are non-refundable.

Please note in such cases where a replacement is not available refunded amount will stay as store credit to use for future ordering.

Your refund will be initiated once your product is received back and inspected by our team. You will receive the refund as store credit within 24 hours after your product is received back and inspected by our team.

If you have cancelled your order before shipping, refund will be provided back to you in your store credit to use for future ordering.

No refunds (if paid by store credit or online payment) when order is cancelled after shipping. However, if payment mode is cash on delivery and the order is canceled once shipped, such customer account will get blocked for future cash on delivery orders.

    PRODUCT LIABILITY

    By placing an Order through our Site, you acknowledge and agree that full liability for the products rests with the manufacturer and that we carry no product liability for those items save as described in the Returns section in relation to returning the products and refunding the price paid (where applicable).

    DESCRIPTIONS

    At the time of publication on our Site, all product descriptions are believed to be accurate. We also strive to represent the products on our Site as accurately as possible, however colours and resolution may vary depending on your monitor’s display. All measurements and weights are approximate.

    INDEMNITY

    You agree to defend, indemnify and hold us, our directors, agents, affiliates, licensors and suppliers harmless from and against any and all claims, damages, costs and expenses, including legal fees, arising from or related to your use of the Website and/or your breach of any representation, warranty, or other provision of the Site Terms, including the use by third parties accessing the Site using your account caused by your action or inaction.

    LANGUAGE

    These Site Terms are published in English and Arabic. If there is any inconsistency between the English text and the Arabic text, the English text will apply.

    DISPUTES AND GOVERNING LAW

    These Site Terms are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai and all disputes arising here under are subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

    Dispute Resolution:

    If you are not satisfied with any products that you have purchased using our Site, you should contact us through email, social media or live chat on the Site.

    Third Party Rights:

    A person who is not a party to these Terms & Conditions has no right to enforce any of its term.

    Relationship of the Parties:

    Nothing contained in these Terms & Conditions will be deemed or construed by the parties or any third party to create the relationship of partnership or joint venture between the parties, it being understood that the parties will at all times remain independent parties contracting for services.
